I had my first home poker tourny last night and we had a problem with a ruling.

There was a flush on the board.

Player A said its a split pot because only the best 5 cards count
Player B said that the player with the highest hole card takes it who's right?

Depends on the cards. It is a split pot if all cards on the board are higher than anyone's hole cards; otherwise, whoever has the highest hole card of the Flush suit wins the pot.

king of hearts ten of hearts 5 of hearts 9 of hearts 2 of hearts

And the players are holding ace of clubs 3 of diamonds and 9 of diamonds 9 of spades then it's a split pot. The ace of clubs doesn't play and neither does the pair of 9s.

If the players are holding 4 of hearts 4 of diamonds and 8 of hearts 9 of clubs, then the player with 8 of hearts wins since:

king of hearts ten of hearts 9 of hearts 8 of hearts 5 of hearts
beats
king of hearts ten of hearts 9 of hearts 5 of hearts 4 of hearts

Allow me to add:

If the board is  king of hearts ten of hearts 9 of hearts 7 of hearts 5 of hearts and the players have  ace of clubs 7 of spades and  king of clubs 3 of hearts , it is still a split pot, because the 5 hearts on board are higher than the player's 3 of hearts.

Could be possible for both the situations. Basically it depends on the cards. If both the players are having same ranking cards then they have to split the pot. But if one of the players having more ranking cards then he will have the winning amount.

I could see a couple of people I've played with have trouble with this situation.

Board:   ace of hearts jack of hearts 9 of hearts 5 of hearts 4 of hearts

Player 1:  ace of spades king of hearts
Player 2:   2 of hearts 6 of hearts

Player 1 wins because the K is higher than the 6 even though player 2 has 7 hearts.

Best 5 cards play.

Or you get this situation

 ace of hearts 4 of hearts 5 of hearts ten of hearts jack of hearts

Player one has  queen of hearts king of hearts

player two has  2 of hearts 3 of hearts

In this situation it just gets crazy because they both play the  ace of hearts, and no one at the game really knows the rules.  And player two has a 45 and player one has a 22. PLayer two is a peaceful guy, but player one knows he is packing heavy and is not real familiar with the guy as they have only played a couple of times together. So player one is sweaten bullets while player two has his hand in his jacket. Then the tourney host walks up behind player two with two smokin hot naked hookers that amazingly cost half the pot each, so the two players agree that it is a split pot. But the next day player one post on here and learns that he should have had both hookers.
